Lo spessore della democrazia iscritta nella Costituzione italiana si presenta più profondo dello strato, solo superficiale, delle istituzioni di rappresentanza politica. Quest’ultima disegna, infatti, una delle estensioni del legame sociale che, più in profondità, unisce la società, coordina le relazioni tra le persone e regola i rapporti. Al di sotto del sistema politico, a conferirne fondamento, si trova una stratificazione di rapporti che la Costituzione non lascia al potere del singolo o di un gruppo, ma che informa ai principi di libertà ed eguaglianza.
In questo disegno di una democrazia «di spessore», perciò non solo politica, ma economica e sociale, dunque «sostanziale», si iscrivono le norme costituzionali sui rapporti economici.
I “rapporti economici”, infatti, nella Costituzione italiana sono stati regolati nel bilanciamento tra le libertà di iniziativa economica, il diritto di proprietà e, d’altro lato, il principio di uguaglianza che impone un riequilibrio dinamico delle situazioni soggettive e collettive. Il bilanciamento tra questi principi era definito dai Costituenti come la “finalizzazione delle libertà”, ovvero il contemperamento delle libertà e il loro indirizzamento verso le finalità costituzionali e, tra queste, in particolare la promozione del lavoro «in tutte le sue forme e applicazioni» (art. 35 Cost.) come luogo e tempo privilegiati di sviluppo della persona umana e di costruzione del le-game sociale. In questo senso le disposizioni economiche della Costituzione hanno messo al centro la “persona che lavora” e non il lavoro come fattore produttivo.
Per attuare questo progetto, la Costituzione ha voluto attribuire ai lavoratori un ruolo rilevante nelle fabbriche e nell’organizzazione dello Stato, prevedendo sia istituti redistributivi che partecipativi (o predistributivi): i primi finalizzati a modificare i «caratteri del processo di accumulazione, con l’obiettivo di realizzare un maggior controllo, una titolarità diffusa dei processi economici e una deconcentrazione della ricchezza»; gli istituti partecipativi, invece, tendono a perseguire l’«uguaglianza nella distribuzione delle risorse, delle opportunità, dei costi e dei benefici prodotti dal sistema sociale ed economico».
