Negli ultimi anni si registrano dati preoccupanti: la perdita di biodiversità, l’estinzione di specie ittiche e la desertificazione che divora sempre più le terre fertili. Gli effetti nocivi del cambiamento climatico sono già evidenti. I disastri naturali sono più frequenti e devastanti; i Paesi in via di sviluppo sempre più vulnerabili. L’inquinamento dell’aria, dell’acqua e dei mari continua a negare una vita dignitosa a milioni di persone.
L’era in cui si credeva che l’uomo potesse controllare la natura è passata. Bisogna prendere atto che certe condotte hanno effetti irreversibili sull’ambiente. Del resto, tale condizione non è del tutto nuova. Già nel 1971, Massimo Severo Giannini sottolineava la necessità di tutelare l’ambiente, evidenziando come la stessa «muove dalla consapevolezza che mentre in precedenti periodi storici c’è stato un equilibrio tra il fatto creativo ed il fatto distruttivo dell’uomo, ovvero, l’uomo creatore ha prevalso sull’uomo distruttore, oggi questo equilibrio si è rotto e prevale l’elemento negativo: le forze distruttive sono maggiori delle forze costruttive».
Partendo da queste premesse, Massimo Severo Giannini affermava l’inizio di un ciclo volto ad aggiungere una nuova categoria di beni giuridici, costituita dai beni collettivi non patrimoniali. Un’enunciazione che ha profondamente influenzato la giurisprudenza costituzionale, la quale per decenni ha propeso per una concezione teleologica della tutela ambientale, stante l’evidente difficoltà di racchiudere il patrimonio naturale nei tradizionali ambiti materiali predisposti dall’ordinamento.
Come si vedrà, tuttavia, il processo enunciato dall’autorevole giurista ha richiesto un lungo periodo di formazione. Si è reso necessario, dapprima, individuare gli elementi costitutivi del patrimonio naturale e attribuire a quest’ultimo la qualifica di bene meritevole di tutela giuridica. In secondo luogo, è stato indispensabile affermare l’esistenza di un diritto ad un habitat naturale salubre, riconoscendo, solo recentemente, espresso valore costituzionale all’ambiente e alla tutela delle future generazioni, attraverso una revisione degli artt. 9 e 41 Cost., operata mediante una modifica “additiva”, che ha segnato finalmente un “risveglio” del legislatore e dato avvio ad un cambio di rotta dell’economia, sempre più ecologica. In ultimo, è stato utile specificare i comportamenti in grado di incidere sul bene ambiente.
