Pur essendo ampiamente diffusa nelle discipline economiche, la nozione di «concessione portuale» è ignota all’ordinamento italiano, che la conosce solo indirettamente ed attraverso differenti qualificazioni terminologiche.
La suddetta espressione è inoltre declinata negli ordinamenti di altri Paesi con accezioni che possono essere, in parte, diverse.
È pertanto necessario chiarire sin d’ora che con tale espressione si intende qui far riferimento allo strumento giuridico attraverso il quale un’autorità preposta alla gestione di un porto marittimo nazionale concede ad un determinato operatore un’area ricadente nell’ambito portuale, affinché su di essa egli svolga una o più operazioni o servizi portuali, concordate con la stessa concedente.
Questa, pur sommaria, definizione consente di rilevare come mediante il rilascio di una concessione portuale l’ente competente persegua una duplice finalità, la quale consiste, per un verso, nella regolazione di parte consistente delle attività svolte all’interno del porto, conseguita attraverso la ripartizione fisica degli spazi portuali; per altro verso, nell’attribuzione di specifici diritti e facoltà in favore di taluni operatori che, proprio attraverso l’acquisizione delle aree concesse, sono posti in condizione di svolgere determinate attività nel porto.
Sul piano del diritto positivo interno, l’istituto che l’espressione in esame sottende è riconducibile a quel complesso di figure che l’art. 18 della l. 28 gennaio 1994, n. 84 (“Legge di riordino del sistema portuale”) ricomprende nella rubrica “concessione di aree demaniali e banchine”. La norma, pur introducendo nell’ordinamento una fattispecie originale, rappresenta tuttavia l’esito di una lunga e articolata evoluzione che ha contraddistinto la normativa portuale e più in generale la disciplina dei beni del demanio marittimo.
