L’interesse per uno studio sulla nullità nel diritto amministrativo è stimolato da diversi fattori.
La nullità è uno dei terreni più complessi su cui si misurano le ricostruzioni dogmatiche dei sistemi giuridici, sia perché i confini della nullità insistono su quelli che delimitano il mondo giuridico – distinguendo ciò che è giuridico da ciò che non lo è –, sia in quanto la nullità è un’evidente anomalia del sistema, rappresentando la negazione logica della regola fondamentale che governa la dinamica della produzione giuridica, secondo cui ad ogni atto è associata la produzione di effetti.
Nel diritto amministrativo il problema della nullità si pone in termini peculiari che riflettono le particolarità del diritto pubblico, tradizionalmente ostile ad ammettere la nullità – vuoi per la difficoltà di superare alcuni dogmi ormai anacronistici, vuoi per ragioni di ordine pratico – e spesso più propenso a ricercare un rifugio rassicurante nell’annullabilità.
Le incertezze che hanno storicamente caratterizzato il concetto di nullità, e in particolare la nullità nel diritto amministrativo, sono state solo in parte superate con la codificazione operata della legge 11 febbraio 2005, n. 15 e con l’avvento del Codice del processo amministrativo, che all’art. 31, comma 4, ha disciplinato la relativa azione.
Tale disciplina, sostanziale e processuale – e, di riflesso, l’interpretazione che ne è stata fornita da parte della giurisprudenza – risente ancora dei pregiudizi e delle confusioni che sin dall’inizio del Novecento hanno caratterizzato la figura della nullità dell’atto amministrativo.
In particolare, nella seconda metà dello scorso secolo, il noto dibattito che ha caratterizzato la questione del riparto di giurisdizione tra giudice ordinario ed amministrativo ha attratto a sé ed assorbito ogni riflessione sulla categoria della nullità di diritto amministrativo, finendo per condizionarne profondamente gli esiti sul piano metodologico e dei contenuti.
